POSITION OPENING

FULL-TIME POLICE OFFICER

 

Job Description: The City of Babbitt is accepting applications for the position of a full-time police officer. We will be considering both lateral and entry level police officers for this position. Lateral officers must have at least one year of experience in law enforcement and compensation will be negotiated based upon experience. The City of Babbitt has approximately 1400 residents and encompasses more than 107 square miles of jurisdiction. The City of Babbitt is located within the Superior National Forest, approximately 20 miles from the Boundary Waters Canoe Area Wilderness. The area hosts a variety of outdoor recreational opportunities and serves as a vacation destination for many who enjoy our forests, lakes, trails, and campgrounds. When fully staffed, officers work 12-hour shifts on a 5 and 2 type schedule.

 

General Statement of Duties: Perform responsible police work to protect life and/or property, enforce state laws and local ordinances, render first aid, and create and maintain public safety and relations. All applicants must be licensed by the Minnesota POST Board or be eligible to be licensed by the date of employment. All applicants must have a valid driver’s license. The selected applicant must also pass a medical and psychological exam, as well as a background check, prior to employment.

 

Pay Rate: $30.44 Patrol (Base Wage); $36.44 Patrol (Top Wage); $0.50 Night Shift Differential

BOARD OF ADJUSTMENT

PUBLIC HEARING NOTICE

 

The Ely Board of Adjustment will be holding a public hearing for considering a Conditional Use Permit Request on Wednesday, April 17, 2024 at 5:00 pm in the City Hall council chambers. At this public hearing the Board of Adjustment will be considering the approval of a Conditional Use Permit application submitted by the City of Ely; proposal located at 26 E Conan St and 36 E Conan St Parcel# 030-0050-00170, and 030-0050-00150. The City is seeking to build a parking lot on both properties to provide parking to the public and private businesses in the area.

 

Public comment will be heard on the date of the hearing and/or may be submitted to any of the following addresses below before April 12th to be included in the public hearing. Names and addresses must be submitted in order for comments to be recorded into the hearing minutes.

Regular Meeting Ely City Council – City Hall, Council Chambers

March 12, 2024 Minutes

 

CALL TO ORDER

Mayor Omerza called the council meeting to order at 5:30pm.

 

PRESENT: Council members A.Forsman, Kess, Debeltz, Callen, Campbell, Bisbee, and Mayor Omerza

ABSENT: None

 

APPROVAL OF MINUTES:

Debeltz/Callen moved to approve the minutes from the February 20, 2024 Regular Council Meeting. Motion Carried Unanimously.

 

ADDITIONS OR OMISSIONS TO AGENDA: None

 

MAYOR’S REPORT:

2024 Sexual Assault Awareness Month Mayor Proclamation – Mayor Omerza read the proclamation.

Mayor Omerza congratulated the Prospector ATV for the National Award they received for the Beaver Bridge Project.

Executive Director Cindy Smyka of Visit Ely, MN received the 2024 Explore Minnesota Emerging Leader Award.

Mayor Omerza indicated that she was in St. Paul this last week and attended hearings for the International Wolf Center Bonding Bill and for EMS. One thing she stated was that our EMS service area is the size of Rhode Island with approximately 5000 people.

 

CONSENT AGENDA:

A.Motion to waive readings in entirety of all ordinances and resolutions on tonight’s agenda.

B.Approve Council and Staff to attend the Chamber of Commerce Annual Meeting on April 17, 2024 and Celebrate Ely Event on April 11, 2024 at the Grand Ely Lodge.

C.Local Board of Appeal and Equalization Meeting on April 11, 2024 from 5-6pm at Ely City Hall Council Chambers.

Debeltz/Campbell moved to approve the Consent Agenda items A-C. Motion Carried Unanimously.

 

Debeltz/Campbell moved to make the Chamber Annual Meeting on April 17, 2024 a Special Council meeting so all council members can attend if they choose. Motion Carried Unanimously.

COMMITTEE REPORTS:

Standing/Special

Tree Board

Bisbee/Kess moved to approve the recommendation from the Tree Board to display the Tree City USA flag somewhere in City Hall. Motion Carried Unanimously.

Bisbee indicated that it will be the 10th year of Tree City USA, and the tree board is planning a celebration to state the proclamation and displaying the Tree City Flag.

 

Bisbee/Kess moved to approve the recommendation from the Tree Board to provide financial support for travel expenses of not more than $270 to send Claudia McBride to the Shade Tree Short Course in the Twin Cities.

Langowski suggested that the budget for this comes from the Council Travel and Training budget since committees do not have a travel and training line item in the budget.

Motion Carried Unanimously.

 

Planning and Zoning Commission

Campbell/Debeltz moved to approve the recommendation from Planning & Zoning to proceed with the Miners Lake East Parking Area Project and to have a portable restroom.

Kess asked if there is money in the budget for a portable restroom. Langowski indicated that we have several around town and can move one from another spot. Langowski also indicated that we will install a light for the parking lot and trash can.

Motion Carried Unanimously.

 

Recommendation from Planning & Zoning for Attorney Klun to review the State noise and lighting requirements.

Langowski stated that there is state statute concerning noise and light pollution on developments. When a project is developed, they are required to follow the building code, zoning code, our local ordinances and state and federal laws. Langowski indicated that he’s not sure if there is a reason to add additional ordinances concerning noise or light when we follow the MPCA guidelines on it.

Attorney Klun indicated if there is a specific request, we can look at to what changes need to be made.

Campbell stated she will take it back to Planning and Zoning for more discussion.

 

Heritage Preservation Commission

 

Telecommunications Advisory Board (TAB)

Debeltz/Bisbee moved to approve the recommendation from TAB to authorize additional filming to be authorized at the proposed rate of $25 per hour for events and meetings authorized by TAB on a monthly basis. Motion Carried Unanimously.

 

Employee Relations

Debeltz/Bisbee moved to approve the recommendation from Employee Relations to offer the position of Water/Wastewater Operator to Destin Anderson. Motion Carried Unanimously

 

Debeltz/Campbell moved to approve the recommendation from Employee Relations to approve the budgeted pay increases for the Fire Department. Motion Carried 6-0-1 with Callen Abstaining since he is on the Fire Department.

 

Budget Committee

A.Forsman/Callen moved to approve the recommendation from Budget Committee to approve Invoice #2024 for $7,500 to the Senior Center. Motion Carried Unanimously.

Bisbee/Debeltz moved to approve the recommendation from Park & Rec to allow Jeremy Kershaw with the Heck of the North Bike Race to camp at Semers Beach on July 19-July 20th. Motion Carried Unanimously.

 

Ely Utilities Commission (EUC)

A.Forsman/Kess moved to approve the recommendation from EUC to purchase 48 load management relays for $9,984.00. Motion Carried Unanimously.

 

A.Forsman/Callen moved to approve the recommendation from EUC to hire Destin Anderson for the Water/Wastewater Operator II position, as he is eligible and meets the job description requirements. Motion Carried Unanimously.

 

A.Forsman/Campbell moved to approve the recommendation from EUC to approve Langowski to attend the 2024 Type IV Land Application Refresher in St. Cloud, MN on March 26, 2024. Motion Carried Unanimously.

 

A.Forsman/Debeltz moved to approve the recommendation from EUC to purchase 2 mechanical seal kits for $3,268.00 each for a total of $6,536 from Tri State Pump & Control. Motion Carried Unanimously.

DEPARTMENTAL REPORTS:

Clerk-Treasurer

Update on Housing Project

Langowski stated that working with the HRA we were able to get a developer for the Housing Project, DW Jones. The housing study has been updated to look at a market rate apartment building, and the demand for that came back with an additional 215 units could be utilized in Ely. The project is now looking at an apartment building with 37 units, 3 stories, with about 20 garage stall covered parking stalls. The units will consist of studio size all the way up to 3 bedrooms, 2 bath and 1200 square feet. Our market study looked at what the affordable rates are and right now the project is taking those numbers and trying to get the project at rents below what the market is saying right now. By the end of April, we will need to complete an application to the Minnesota Housing and Finance for the workforce piece. DW Jones is putting together all the documentation for that. Langowski submitted an application to the IRRR for their housing program, we applied for $1 Million for the project and it is looking like we might get $850,000. We should know by August what the award will be for the Minnesota Housing and Finance part. We will hopefully get some preliminary utility and site work done this fall of 2024 and the construction will start in 2025. The cost of the project is around $8.4 Million for a 37-unit Apartment Building and will possibly have around $3.4 Million in bonded debt. We would have to use St Louis County’s debt capacity, so we have been talking with them as to how that will work out. The HRA will be the owner of the apartment complex, and EW Jones is the developer. The construction would take about a year, so looking at occupancy around 2 years from now. At the next council meeting we will discuss the zoning for the area.

 

Fire Chief

Chief Marshall thanked the council for approving the fire department wage increases. Chief Marshall discussed the current fire and medical calls for the Fire Department. Marshall indicated that new firefighter Erin Kelly passed her Firefighter 1 exam and tests.

 

Library Director

2023 MN Public Library Annual Report and Ely Library Usage Groups by Circulation

Library Director Heinrich discussed the current programming for the Ely Library which can be found on the library website.

 

Police Chief

Chief Houde indicated that Calendar Parking is still in effect, the even though the snow is gone the city still needs to street sweep the streets and cannot do that until it is above freezing.

 

City Attorney

Debeltz/Campbell moved to approve the Second Reading of Ordinance 375 2nd Series- An Ordinance of the City of Ely, Minnesota adding to the Ely City Code, Chapter 2, section 2.66, Ely Housing Fund. Roll Called: Council Members A.Forsman – Yes, Kess- Yes, Debeltz – Yes, Callen – Yes, Campbell – Yes, Bisbee – Yes, and Mayor Omerza – Yes. Motion Carried Unanimously.

 

Bisbee/Debeltz moved to approve the Note and mortgage for the Residential Rehab Loan for Charlotte Ackerley for $9,000 at 226 E Conan St. to upgrade to a propane furnace. Motion Carried Unanimously

A.Continued discussion with Planning and Zoning to discuss the updated evaluation of permissible and conditional uses list.

Langowski discussed the Zoning District Definitions and the locations of the Zoning districts.

What X’s and O’s mean on List of Permissible and Condition Uses List

Langowski indicated that an O means that a use is permitted in that district only if a conditional use permit is granted by the Board of Adjustment. A X means the that use is permitted in the district, subject to the general provisions of the Zoning Chapter in the Code.

Banovetz indicated that the Planning and Zoning Commission has been working on the Permissible and Conditional Use List for the last 3.5 years with the whole commission.

Langowski indicated that we have been trying to fix errors or issues that have been adopted over the years.

Banovetz indicated that they have been trying to get some uniformity throughout the city and this should also be a part of our Comprehensive Plan.

Langowski indicated that we are working to update the zoning map, and to have an electronic copy and to have it included on the St Louis County Land Explorer. The goal is to get the zoning updated to be correct as to what is currently there, but spot zoning is not allowed so that is what takes time.

Kess discussed the apartments above businesses – proposed apartments 1, 2 ,3 and 4 units are not allowed in C1 & C2.

Discussion was had whether apartments would be allowed in commercial areas or whether a Conditional Use Permit would need to be applied for, or whether they are grandfathered in. Discussion was also had on primary and secondary uses of buildings, the primary use on some of the structures is retail along Sheridan Street, then the secondary use would be apartment.

Attorney Klun indicated that new owners of the buildings would not be grandfathered in with the current use unless a conditional use is recorded on that property, or if it is an allowed use. Currently our C-1 district is really large and has both residential and rentals in it.

Kess indicated that in the proposed zoning the Dwelling, single family would not allow a residential home in C-1.

Langowski indicated that we should be promoting these apartments above these businesses. This would be a good task to take a further look at in the commercial district.

A.Forsman indicated that Residential and Apartments in C-1 should be allowed. The market is going to determine the use of these properties. These should be allowed uses without a CUP needed.

Kess stated that we should be using these commercial properties as combination housing with what we need for housing these days.

Langowski indicated that when we established rules for Short Term Rentals, we put less restrictions on Commercial district to encourage more Short Term Rentals in the Commercial areas versus Residential.

Langowski discussed the zoning district schedule, provisions, the footprint, sidewall dimension, lot width, setbacks, etc.

A.Forsman discussed concerns with the footprint. With the cost of building these days and the fact that people are not building because of the cost. The footprint of his house when it was built would not be allowed, because it would be under the 768 feet. Since it was built, he has added on to the front and back of the house, so he is over the minimum now, but at the time the footprint was smaller. Having the 768’ footprint can be limiting to people.

Langowski indicated that the 768 square feet is the minimum for a single-family home. We have looked at changing that to make is larger, cause people are building larger house and that is a larger tax value. But then we started to see the construction costs go up. If people are proposing to build a house smaller than 768 Square feet, we tell them to put the plans together and maybe we can find a solution for the project with variances.

Kess indicated that some of the current homes around Ely are smaller than the minimum, but they fit the neighborhood.

Banovetz indicated that he would like the council to look at changing the ordinance for smaller homes, so it doesn’t fall on the shoulders of Planning and Zoning to issue CUPs and variances.

Langowski indicated that it would be beneficial to have Scott K research what other cities are doing for smaller homes.

 

Business Park Covenants

Langowski went through the Business Park plan and requirements. The business park is from the county services building to the Department of Revenue or where the VA clinic is located and that is what these covenants were established for. At one time we designated this a Job Z zone since the state was offering some incentives for that at the time. Things have changed in that area since its development. Now we need to look at that area and revise the ordinance regarding the business park and the zoning of that area.

Banovetz indicated that there is no zone that is business park, so in that area we could have multiple zones. In the Business Park packet some things don’t agree with the ordinance.

Kess indicated that he was on the original committee that set these business park up. He said they worked hard to make this happen in this area, it was developed to be like a C-2 district which is sperate from the retail districts, and requiring more land, parking and more space. It might be time to eliminate the Business Park covenants and go with a C-2 district.

Attorney Klun indicated that we could make it a C-2 district and remove the covenants, at the time it was marketing for the area to call it a business park. We also need to work on some of the definitions of what the uses mean.

Langowski indicated that we also need to look at the open lots and what we want to be there in the future.

Kess indicated he would like to direct city staff, the zoning department, clerk and Attorney Klun to work on this.

A.Forsman indicated that we need to remember that things are going to change and are not going to be perfect for every circumstance for future development.

Langowski indicated that we can work on this internally and then bring back to the council.

 

Storage Tanks

Langowski indicated that the storage tanks would fall under the state of Minnesota, state statutes and guidance from the Minnesota Pollution Control Agency and other departments for regulation.

A.Forsman questioned the storage tanks at the Joint Maintenance Garage. He said there is a propane tank and diesel fuel and regular gas storage tanks on that property. The school district also has a bulk propane tank.

Kochendorfer indicted that discussion on this has been regarding the primary and secondary uses of these. The storage tanks are the secondary uses for the properties and supplementing the business that are there.

 

 

Classification List – Permissible/Conditional Uses Current/Proposed

Langowski indicated that the goal is to have accomplished is revisions to this list and for those to become codified through ordinance. Through our discussion tonight we have a few areas to look at, the apartments above in a commercial district, the daycare and childcare, and the dwellings single family allowed in Commercial -1. It is impossible to have every single use listed, but to look at things that come up. Storage units have come up recently, so where do we allow those, it is also good to look at other communities as to where they put these units.

Kochendorfer asked if a use comes forward that is not on the list, how do we go about that and what is the process to bring those forward.

Attorney Klun indicated that in the past the potential use has been brought forward to the council and we have added it through the ordinance process. She would suggest they would go to the Planning and Zoning first and then recommended to the council.

 

Omerza asked what are the next steps to take.

Langowski indicated that the chart of uses that we discussed the most the apartments, zoning districts of where they are allowed and where they are not allowed. If anyone has any questions or concerns on these uses let Langowski or Kochendorfer know and we can work through them. We can work through this internally and then bring it back to the council.

AN ORDINANCE OF THE CITY OF ELY, MINNESOTA, REVISING THE ELY CITY CODE CHAPTER 11, SECTION 4 CONDITIONAL USES.

 

THE COUNCIL OF THE CITY OF ELY DOES HEREBY ORDAIN:

 

SECTION 1.  Chapter 11, Section 4 of the Ely City Code is amended to read as follows:

 

SEC. 11.40. LIST OF PERMISSIBLE AND CONDITIONAL USES. On the following table, the uses listed are the primary use in the district. An open circle, “O”, means that the use is permitted in that district, only if a conditional use permit is granted by the Board of Adjustment. An “I” means that the use is permitted in that district only if an interim use permit is granted by the Board of Adjustment. An “X” means that the use is permitted in the districted, subject to the general provisions of the Zoning Chapter. A blank space means that the use is not permitted in the district. For uses not included on this list, application shall be made to the Board of Adjustment for a determination that the proposed use is or is not of the same general character as a permitted, not permitted, or conditional use.

 

SECTION 2. Effective Date:  Pursuant to Section 3.08 of the Charter of the City of Ely, Minnesota, the adoption of this Ordinance is effective thirty (30) days after final adoption and publication.

NOTICE AND ORDER FOR HEARING ON PETITION FOR PROBATE OF WILL APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS

 

It is Ordered and Notice is given that on April 22, 2024, at 9:30 a.m. a hearing will be held in this Court at 300 5th Ave. S. Virginia, Minnesota, for the formal probate of an instrument purporting to be the Will of Decedent, dated October 20, 1992, under Minn. Stat. 524.2-513 (“Will”), and for the appointment of Theresa A. Fuhrmann whose address is 519 Voyager Road, Ely, MN 55731, as personal representative of the Estate of the Decedent in an unsupervised administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the personal representative will be appointed with full power to administer the Estate, including the power to collect all assets, pay all legal debts, claims, taxes and expenses, to sell real and personal property, and do all necessary acts for the Estate.

 

* This hearing will be held remotely via Zoom Technology.

 

Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

SUMMER LABORERS NEEDED

 

The City of Ely is looking for part-time summer general laborers.  Applicant’s must be at least 16 years of age and have a valid driver’s license.  Multiple positions are available for public works, park and recreation, and the utilities department.  Work tasks include mowing, painting, pot hole patching and other general maintenance tasks.  Hours are flexible and we provide training on all equipment operated.  Starting wage is $15/hour.

Important Information Regarding Property Assessments

This may affect your 2025 property taxes.

 

The Board of Appeal and Equalization for the City of Ely, MN will meet on April 11, 2024 from 5:00pm-6:00pm in the Council Chambers at City Hall, 209 E Chapman St. The purpose of this meeting is to determine whether taxable property in the jurisdiction has been properly valued and classified by the assessor, and also to determine whether corrections need to be made.

 

If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you are still not satisfied with the valuation or classification after discussing it with your assessor, you may appear before the Local Board of Appeal and Equalization. The board shall review the valuation, classification, or both if necessary, and shall correct it as needed. Generally, an appearance before your local board of appeal and equalization is required by law before an appeal can be taken to your county board of appeal and equalization.
