A Burnsville man was apprehended by authorities after he allegedly entered an Ely residence.
Several criminal charges were filed against Adrian Ybarra, 40, as a result.
Police also contend that Ybarra resisted and fought with them, swore at them, and broke a dome light off inside a police squad car.
Ybarra faces a gross misdemeanor charge of criminal damage to property, misdemeanor charges of disorderly conduct and trespassing, and a petty misdemeanor count of criminal damage to property.
The charges stem from an Oct. 5 incident.
According to a criminal complaint, Ely police were dispatched to a local residence that night, to the report of a male located in the reporting party’s basement.
The reporting party also indicated that the male first tried to make entry into a side door.
When an Ely officer arrived, he joined a state trooper in making entry to the south side of the building, where they located a male later identified as Ybarra laying on the ground at the bottom of the basement stairs.
Ybarra was detained by officers, but police say he became uncooperative and physically resisted being placed in handcuffs.
Police say that Ybarra was uncooperative and at one point refused to stand or walk on his own, and that he “consistently yelled racial slurs and homophobic comments during the incident.” Ybarra was slightly bleeding from the elbow and was examined and cleared by EMS personnel, and he was later placed in the backseat of a patrol vehicle.
Officers investigated at the residence and found that a baseplate of a doorframe had been damaged, and the home owner advised police that Ybarra was “adamantly attempting to force entry into the second door in the basement” upon the officers’ arrival.
The homeowners also provided security camera footage of Ybarra walking up to the west side of the house shortly before he forced entry into the basement.
Later, an Ely officer was advised that Ybarra, while in the police vehicle, slipped his handcuffs off, broke the dome light in the back of the squad car and was bleeding.
To prevent further injury, police took Ybarra to Ely-Bloomenson Community Hospital, where his injury was cleaned up and he was cleared for jail.
Police say Ybarra remained uncooperative at the hospital, refusing to follow commands and continuing with slurs directed at hospital staff. He was subsequently taken to the county jail in Virginia.
