AN ORDINANCE OF THE CITY OF ELY, MINNESOTA,
AMENDING CHAPTER 10, SECTION 10.01 REGULATING STORAGE, DEPOSIT, AND DISPOSAL OF REFUSE

THE COUNCIL OF THE CITY OF ELY DOES HEREBY ORDAIN:
SECTION 1 Chapter 10, Section 11.01, of the City Code of the City of Ely, Minnesota is amended to read as follows:
SEC. 10.01. STORAGE, DEPOSIT AND DISPOSAL OF REFUSE .
Subd. 1. Definitions. The following terms, as used in this Section, shall have
the meanings stated:
A. “Refuse” means and includes all drained organic material resulting from the preparation of food and spoiled or decayed food from any source, bottles, cans, glassware, paper or paper products, crockery, ashes, rags, and discarded clothing, tree and lawn clippings and solid market and industrial wastes.
B. “Commercial establishment” means any store, restaurant, gas station or business, either retail or wholesale, operated for profit.

Subd. 2. Storage.
A. It is unlawful for any person to store refuse on commercial establishment premises for more than forty-eight (48) hours. Such storage shall be in containers as for residential dwelling premises, except that so-called “dumpsters” with close-fitting covers may be substituted.
B. It is unlawful to store organic refuse unless it is drained and wrapped.
Subd. 3. Deposit. It is unlawful for any person to deposit refuse from any source, rubbish, offal, or the body of a dead animal, in any place other than a sanitary landfill.
Subd. 4. Fire Danger. It is unlawful for any person to store, deposit or dispose
of any refuse which is in flames or heated to the point where it could cause danger of fire in other refuse.
Subd. 5. Improper Use of City Recycling Center. Disposing
of household, business or other non-recyclable items in City provided recycling containers or on City provided property is an unlawful use of the containers and/or property provided by the City for recycling. A person who violates this subdivision shall be guilty of a petty misdemeanor.

Subd. 6. Improper Use of Corner Cans and City Provided Garbage Cans/ Dumpsters. The City provides Street Cans (also commonly known as Corner Cans) in some areas with high pedestrian traffic. These cans are for pedestrian garbage only, defined as garbage generated while walking. Disposing household or business garbage in these cans, or other garbage cans/ dumpsters provided by the City, is unlawful. A person who violates this subdivision shall be guilty of a petty misdemeanor.

SECTION 2. Effective Date: Pursuant to Section 11.40 of the Charter of the City of Ely, Minnesota, the adoption of this Ordinance is effective immediately after final adoption and publication.
